China Regulates Rare Earth Exports Part I

Recently, China announced new regulations to strengthen export controls on certain rare earth-related items, drawing widespread attention and diverse interpretations. Some international media outlets have characterized this move as a "diplomatic card" or "strategic weapon" played by China in trade frictions. However, if this policy upgrade is examined within the macro framework of global governance norms, China's own industrial development needs, and international responsibilities, a more fair and rational conclusion is that this measure is an inevitable step for China, as a major global supplier of key minerals, to proactively align with international practices, improve its governance, and fulfill its responsibilities as a major power. It is not a so-called "tactical countermeasure" on a whim, but rather rooted in the deep-seated needs of China's own sustainable industrial development and resonates with the global trend of standardized management of strategic resources, ultimately aiming to achieve the sustainable utilization of strategic resources and global common development.

 

China's new rare earth export control regulations are a proactive alignment with international norms, with the core legal basis lying in the "dual-use" nature of rare earth items. Rare earth elements are not only key components in the manufacture of new energy vehicles, consumer electronics, and wind turbines, but also play an indispensable role in advanced military equipment such as fighter jets and nuclear facilities. Therefore, preventing these strategic resources from being used to undermine international peace and security is an international non-proliferation obligation that all countries must fulfill. In fact, export controls on strategic resources with clear dual-use attributes are a common international practice and a legitimate right of a sovereign state to safeguard its own security and fulfill its international obligations. Therefore, China's export controls on rare earth-related items in accordance with the law are not barriers targeting specific countries, but rather a responsible act to earnestly fulfill its international non-proliferation obligations and uphold the principle of non-discrimination in maintaining world peace and regional stability.
